Notes for Clients Regarding Residential Property Work

Conduct of the files

All residential cases are conducted on a day to day basis by individually assigned fee earners. Each fee earner in Gudgeons Prentice is fully qualified as either a solicitor; legal executive, or licenced conveyancer with a number of years’ experience in property law. All fee earners are assisted on a day to day basis by their own secretary, so if the fee earner is engaged they can assist. What is included within the service?

Sales

Included within our estimated cost for the work we conduct on your behalf are as follows:-

  1. Obtaining the title information and preparing the contract pack for the buyers solicitors;
  2. Negotiating the contract;
  3. Negotiating the transfer deed;
  4. Assisting with the answering of any pre-contract enquiries raised;
  5. Conducting the exchange of contracts and the completion;
  6. Arranging the repayment of any mortgage against your property;
  7. Paying any estate agents on completion;
  8. Dealing with the discharge of any mortgage at HM Land Registry.

The costs estimate is given on the basis of certain assumptions*, including:-

  1. the property is currently held under a single freehold title at HM Land Registry with no title defects;
  2. one contract is submitted to one purchaser;
  3. the sale will be on the basis of an unconditional contract and you will be vacating the property on completion;
  4. there is only one registered charge against your property;
  5. completion takes place on the date agreed in the contract.

Purchases

Included within our estimated cost for the work we conduct on your behalf are as follows:-

  1. Investigating the title to the property; including the carrying out of the usual searches relating to the title and local government information and reviewing the replies given by the seller to the pre-contract enquiries;
  2. Negotiating the contract;
  3. Negotiating the transfer deed;
  4. Advising you on the contents of your mortgage offer (if applicable);
  5. Preparing for you a report on contract;
  6. Conducting the exchange of contracts and the completion of the purchase;
  7. Arranging the transfer of funds on completion to the sellers solicitors and for the relevant taxes payable;
  8. Calculating stamp duty land tax (SDLT) on the purchase and preparing and submitting to HM Revenue & Customs the appropriate SDLT forms; and
  9. Registering the purchase and the mortgage (if any) at the Land Registry.

The costs estimate has been given on the basis of certain assumptions*, including:-

  1. the property is currently held under a single freehold title at the Land Registry with no title defects;
  2. one contract is submitted to one purchaser;
  3. the purchase will be on the basis of an unconditional contract and the property is acquired with vacant possession;
  4. completion takes place on the date agreed in the contract

Re-mortgages

Included within our estimated cost for the Work we conduct on your behalf are as follows:-

  1. Investigating the title to the property; including the carrying out of the usual searches relating to the title and local government information (if necessary for your mortgage lender);
  2. Advising you of the contents of your mortgage offer;
  3. Arranging your signature to the necessary mortgage documentation;
  4. Arranging the drawdown of mortgage monies on completion;
  5. Redeeming any existing mortgage registered against the title; and
  6. Arranging the discharge of any existing mortgage and the registration of the new charge at the Land Registry;

The estimate of costs has been given on the basis of certain assumptions*, including:-

  1. the property is currently held under a single freehold title at the Land Registry with no title defects;
  2. there is to be no change in the registered owners of the property;
  3. there is a single existing mortgage currently registered against your property; and
  4. the lender does not instruct their own firm of solicitors to act on their behalf.

* If such assumptions are not met, or Gudgeons Prentice are asked to expedite matters, or carry out additional work above and beyond the usual conveyancing process, then additional charges may apply, for which you will be notified in writing.
